Prompt tips
- Tip 1Make the safety question the first thing the agent asks, and write the exact wording for callers in danger, including 911 and the hotline number, so it is never improvised.
- Tip 2Tell the agent to ask for safe contact preferences on every new call and read them back, since one wrong text can put a caller at risk.
- Tip 3Forbid any comment on custody, support amounts or next steps, and give the agent a single approved line that offers a consultation instead.
Rules to watch
Conflicts between spouses. ABA Model Rule 1.18 keeps information from a prospective client confidential even if no representation follows, and receiving significantly harmful information can bar the firm from representing the other side in the same matter. Model Rule 1.7 governs conflicts among current clients. Staff, not the AI, must run and clear every check.
Confidentiality and safe contact. Model Rule 1.6 requires reasonable efforts to prevent unauthorized access to client information. In family matters that includes not sending texts, emails or voicemails to devices the other party may see. Honor the contact preferences collected at intake and keep sensitive facts out of automated messages.
Fees in domestic relations matters. Model Rule 1.5 prohibits fees in domestic relations matters that depend on securing a divorce or on the amount of alimony, support or a property settlement. The AI should describe the firm's fee policy only in approved wording and leave retainer terms to staff.
