Rules to watch

Fair housing in answers and ads. The Fair Housing Act bars housing discrimination based on race, color, national origin, religion, sex, familial status and disability, and it covers notices, statements and ads that show a preference or limitation. Write the prompt so the AI talks about the property, not who lives nearby, and sends questions about what kind of area it is to the agent.

Consent before AI calls and texts. The FCC ruled in February 2024 that AI-generated voices count as artificial voices under the TCPA, so outbound AI calls need the person's prior express consent, and prior express written consent when the call is telemarketing. Put clear consent wording on lead forms before any workflow calls or texts a new lead.

Buyer agreements before tours. Under NAR's settlement practice changes, effective August 17, 2024, MLS participants working with buyers must have a written agreement before touring a home. When the AI books a first showing for a new buyer, have the workflow create a task for the agent to get that agreement signed first.
