Rules to watch

Business calls still have limits. The FTC's Telemarketing Sales Rule exempts most business-to-business calls, but calls to cell phones using an autodialer, prerecorded message or AI voice still need consent under the FCC's TCPA rules. Many owners and decision makers answer on a mobile, so treat outbound AI calls as needing consent unless counsel says otherwise.

CAN-SPAM covers owner and tenant email. Market update emails to owners and tenants are commercial email, and the FTC says CAN-SPAM applies to business-to-business messages too. Each one needs an accurate sender, an honest subject line, a physical postal address and an opt-out honored within 10 business days.
