Prompt tips
- Tip 1Explain in the prompt who the client is in common scenarios, like a child calling for a parent, so the agent sets expectations without sounding suspicious.
- Tip 2List each package with its flat fee and inclusions, and tell the agent to leave 'which documents do I need' questions to the attorney.
- Tip 3Give the agent a separate, gentle script for callers dealing with a recent death, with condolences first and no promotional language.
Rules to watch
Who the client is. When a relative arranges a plan for someone else, the attorney must identify the client and work with them directly. Model Rule 1.8(f) limits accepting payment from someone other than the client, and Rule 1.7 covers conflicts, such as spouses planning together. Clients with decision-making limitations. ABA Model Rule 1.14 addresses clients whose decision-making may be limited and when a lawyer may take protective action. If a caller mentions dementia, memory problems or pressure from family, the AI should record it without comment and flag the inquiry for the attorney.
Prospective clients and seminar marketing. Model Rule 1.18 keeps prospective client information confidential even if the firm declines, and Rule 7.1 bars misleading claims about services. Keep seminar invitations and AI descriptions of packages factual, and avoid blanket promises about avoiding probate or taxes.
